What is FSSAI ?

The Food Safety and Standards Authority of India (FSSAI) is a government agency responsible for ensuring food safety and regulating food businesses in India. It operates under the Ministry of Health & Family Welfare, Government of India, and was established under the Food Safety and Standards Act, 2006. The FSSAI sets standards for food products, oversees the quality of food, and monitors food safety regulations across the country.

Why is FSSAI Important?

  • Food Safety: FSSAI ensures that food consumed by the public is safe and free from harmful substances.
  • Regulatory Compliance: All food businesses in India must comply with FSSAI guidelines to legally operate.
  • Consumer Trust: The FSSAI logo and license number on food products builds trust and reliability, ensuring customers that the food they are purchasing is safe.
  • Nationwide Standardization: It establishes a consistent set of regulations across the country, ensuring uniform food safety practices.

Types of FSSAI Licenses

The type of FSSAI license depends on the size and nature of the food business. There are three types:

1. FSSAI Basic Registration

  • Eligibility: For small food businesses with an annual turnover of up to ₹12 lakhs.
  • Examples: Small food vendors, hawkers, home-based food businesses, small retailers, petty manufacturers, etc.
  • Application Process: Register through the FSSAI portal, submit basic documents like identity proof, and pay a nominal fee.
  • Validity: 1 to 5 years (renewable).

2. FSSAI State License

  • Eligibility: For medium-sized food businesses with an annual turnover between ₹12 lakhs and ₹20 crores.
  • Examples: Mid-size manufacturers, restaurants, food transporters, distributors, wholesalers.
  • Application Process: Apply online via the state FSSAI portal. Required documents include a photo ID, address proof, business details, and safety management plan.
  • Validity: 1 to 5 years (renewable).

3. FSSAI Central License

  • Eligibility: For large-scale food businesses with an annual turnover exceeding ₹20 crores, or for businesses involved in food imports/exports or operating across multiple states.
  • Examples: Large manufacturers, importers, exporters, central government agencies, food chains, e-commerce platforms, hotels with 5-star ratings.
  • Application Process: Requires extensive documentation including a comprehensive food safety management plan, and you apply via the central FSSAI portal.
  • Validity: 1 to 5 years (renewable).

Documents Required for FSSAI License

While the specific requirements may vary based on the type of license, generally required documents include:

  • Passport-sized photo of the applicant
  • Proof of business premises (rental agreement, utility bills, etc.)
  • ID proof of the business owner (Aadhar, PAN card, etc.)
  • Business registration certificate
  • Food Safety Management System (FSMS) plan
  • NOC from local municipality (for large businesses)

FSSAI License Number

Once approved, the food business is provided with a 14-digit FSSAI license number, which must be displayed on food packages or at the food business premises. This number is essential for tracking and regulating food safety standards.

Penalties for Non-Compliance

Operating a food business without an FSSAI license or registration can lead to heavy penalties, including:

  • Fines up to ₹5 lakhs for operating without a license.
  • Imprisonment in severe cases of food safety violations.

Renewal of FSSAI License

It is important to renew the FSSAI license before it expires (1 to 5 years, depending on the license). Businesses must apply for renewal at least 30 days before the expiration date to avoid penalties or disruptions in business operations.

Benefits of FSSAI Registration

  • Legal Benefits: Operate without fear of fines or business shutdowns.
  • Consumer Trust: The FSSAI logo boosts customer confidence in food safety.
  • Business Expansion: Having an FSSAI license can help expand your business as it opens doors for selling food products in other states or exporting.
  • Market Access: Essential for selling on e-commerce platforms and supermarkets.
